GMAC Rules on Qualification and Appointment of Arbitrators
全球調解與仲裁中心仲裁員資格與任命規則
Article 1 – Purpose and Scope / 第一條 目的與適用範圍
These Rules establish the qualifications, appointment procedures, and duties of arbitrators serving under the Global Mediation and Arbitration Center (GMAC).
本規則旨在規範全球調解與仲裁中心（以下簡稱「GMAC」）仲裁員之資格條件、任命程序及職責。
These Rules apply to all arbitrations administered by GMAC and to all individuals listed on the GMAC Panel of Arbitrators.
本規則適用於 GMAC 管理之所有仲裁案件及列入 GMAC 仲裁員名冊之人員。
Article 2 – Qualification Requirements / 第二條 資格條件
To be eligible for inclusion in the GMAC Panel of Arbitrators, an applicant must meet the following minimum qualifications:
凡欲登錄為 GMAC 仲裁員名冊者，須具備下列基本條件：
Professional Background / 專業背景
The applicant shall possess a professional background in law, business, finance, engineering, or another relevant field.
申請人應具備法律、商業、金融、工程或其他相關專業背景。
Experience / 經驗要求
The applicant shall have at least five (5) years of professional experience, or at least three (3) years of experience in dispute resolution, arbitration, or mediation.
申請人應具有五年以上專業經驗，或三年以上爭議解決、仲裁或調解實務經驗。
Integrity and Independence / 品格與獨立性
The applicant shall be of good moral character and demonstrate independence, impartiality, and integrity.
申請人應具良好品格，並能保持獨立、公正及誠信。
Language Proficiency / 語言能力
The applicant must be capable of conducting arbitration proceedings and issuing awards in English or Chinese.
申請人應能以英文或中文進行仲裁程序及撰寫裁決書。
Knowledge of Arbitration Law / 仲裁知識
The applicant should possess a working knowledge of arbitration law and procedures under the GMAC Rules and international arbitration practices.
申請人應熟悉 GMAC 仲裁程序規則及國際仲裁實務。
Article 3 – Preferred Qualifications / 第三條 優先條件
Applicants possessing one or more of the following qualifications shall be given priority for inclusion:
符合下列任一條件者，得優先列入仲裁員名冊：
Holder of professional arbitration credentials such as MCIArb / FCIArb (Chartered Institute of Arbitrators) or equivalent certification.
具有國際仲裁專業資格（如英國特許仲裁學會 MCIArb / FCIArb 或同等資格）。
Licensed attorney or judge with active or retired status.
持有律師或法官資格（在職或退休）。
University professor or scholar specializing in law, international business, or dispute resolution.
為法律、國際商務或爭議解決領域之大學教授或學者。
Demonstrated experience as arbitrator or mediator in prior cases.
曾擔任仲裁員或調解員並具相關經驗者。
Article 4 – Application and Review / 第四條 申請與審查
Applicants shall submit an Application Form, Curriculum Vitae, and Statement of Independence and Impartiality to GMAC.
申請人應向 GMAC 提交《仲裁員申請表》、《履歷表》及《獨立與公正聲明書》。
The GMAC Secretariat shall review all applications and may request supplementary information or an interview.
GMAC 秘書處負責審查申請文件，並得要求補件或面談。
Approved applicants shall be included in the GMAC Panel of Arbitrators and may be publicly listed on the GMAC website.
經審查通過者，將列入《GMAC 仲裁員名冊》，並得於 GMAC 官網公布。
Article 5 – Appointment of Arbitrators / 第五條 仲裁員之指定
Unless otherwise agreed by the parties, GMAC shall have the authority to appoint one or more arbitrators from its official Panel.
除當事人另有約定外，GMAC 有權自官方仲裁員名冊中指定一名或多名仲裁員。
GMAC reserves the right to appoint an arbitrator outside the Panel when special expertise is required.
若案件涉及特殊專業領域，GMAC 得指定未登錄名冊但具備相當專業之人士擔任仲裁員。
The appointed arbitrator shall sign a Declaration of Independence and Confidentiality prior to accepting the case.
仲裁員於接受案件前，應簽署《獨立與保密聲明書》。
Article 6 – Responsibilities and Conduct / 第六條 仲裁員職責與行為規範
Arbitrators shall perform their duties with diligence, impartiality, confidentiality, and professionalism.
仲裁員應以勤勉、公正、保密及專業之態度執行職務。
Arbitrators shall avoid any conflict of interest and immediately disclose any circumstances that may raise doubt about their independence.
仲裁員應避免任何利益衝突，並即時揭露可能影響其獨立性之情事。
Arbitrators shall comply with the GMAC Code of Ethics for Arbitrators.
仲裁員應遵守 GMAC 公布之《仲裁員倫理準則》。
Article 7 – Duration and Renewal / 第七條 登錄期間與續期
Arbitrators shall remain listed for a period of three (3) years, renewable upon review.
仲裁員登錄有效期間為三年，期滿經審查後得續期。
Arbitrators shall update their professional information annually to maintain eligibility.
仲裁員應每年更新其專業資料，以維持資格。
Article 8 – Removal and Suspension / 第八條 除名與暫停
GMAC may suspend or remove any arbitrator who:
GMAC 得對下列情形之仲裁員予以暫停或除名：
Violates the GMAC Code of Ethics or demonstrates misconduct;
違反 GMAC 仲裁員倫理準則或有不當行為；
Fails to maintain independence or impartiality;
無法維持獨立或公正；
Repeatedly fails to perform duties properly or timely;
多次怠忽職守或未能及時履行職務；
Requests removal for personal reasons.
因個人原因申請除名者。
Article 9 – Final Provisions / 第九條 附則
GMAC reserves the right to interpret, amend, and supplement these Rules as necessary.
GMAC 保留對本規則作出解釋、修訂及補充之權利。
