Code of Ethics for Arbitrators of the Global Mediation and Arbitration Center (GMAC)
Preamble / 前言
The Global Mediation and Arbitration Center (GMAC) is committed to maintaining the highest standards of integrity, impartiality, and professionalism in all arbitration proceedings.
全球調解與仲裁中心(GMAC)致力於維護仲裁程序之最高誠信、公正與專業標準。
This Code of Ethics establishes fundamental principles of conduct for all arbitrators serving under the GMAC Arbitration Rules.
本準則旨在確立所有依 GMAC 仲裁規則執行職務之仲裁員所應遵守之基本行為原則。
Article 1 – Independence and Impartiality / 第一條 獨立與公正
Arbitrators shall be independent and impartial in the performance of their duties. They shall avoid any conduct, relationship, or interest that may give rise to doubts about their neutrality.
仲裁員應獨立、公正地執行職務,不得有任何可能影響中立性的行為、關係或利益。
Arbitrators must disclose to GMAC and all parties any facts or circumstances that could reasonably create an appearance of bias or conflict of interest.
仲裁員若知悉任何可能造成偏見或利益衝突之事實,應即時向 GMAC 與各方當事人揭露。
If an arbitrator’s independence or impartiality becomes compromised, they shall immediately resign or be subject to replacement by GMAC.
若仲裁員之獨立性或公正性受損,應即刻辭職或由 GMAC 另行指定替代人選。
Article 2 – Integrity and Professionalism / 第二條 誠信與專業
Arbitrators shall conduct themselves with honesty, fairness, and dignity at all times.
仲裁員應隨時保持誠實、公平與尊嚴之專業風範。
Arbitrators shall not accept any gifts, favors, or hospitality from parties or their representatives that may influence or appear to influence their judgment.
仲裁員不得接受任何可能影響或看似影響其判斷之饋贈、利益或款待。
Arbitrators shall perform their duties diligently and ensure that arbitration proceedings are conducted efficiently and without unnecessary delay.
仲裁員應勤勉履職,確保仲裁程序高效進行,不得無故拖延。
Article 3 – Confidentiality / 第三條 保密義務
Arbitrators shall maintain the confidentiality of all arbitration proceedings, evidence, and deliberations.
仲裁員應嚴格保守仲裁程序、證據與評議過程之秘密。
No arbitrator shall disclose or use any confidential information obtained during arbitration for personal or third-party benefit.
仲裁員不得揭露或利用因仲裁程序所知悉之機密資訊以謀取個人或他人利益。
The duty of confidentiality shall continue after the conclusion of the arbitration.
保密義務於仲裁結束後仍持續有效。
Article 4 – Competence and Diligence / 第四條 能力與勤勉
Arbitrators shall accept appointments only when they possess sufficient competence, expertise, and availability to handle the case effectively.
仲裁員應僅於具備足夠專業能力、知識與時間處理案件時方可接受指派。
Arbitrators shall familiarize themselves with the GMAC Arbitration Rules and applicable laws before conducting proceedings.
仲裁員應於受理案件前熟悉 GMAC 仲裁規則及相關適用法律。
Arbitrators shall issue awards within a reasonable period as required by GMAC procedures.
仲裁員應依 GMAC 規則於合理期限內作出裁決。
Article 5 – Equal Treatment and Procedural Fairness / 第五條 平等與程序公正
Arbitrators shall treat all parties equally and ensure that each party has a full and fair opportunity to present its case.
仲裁員應平等對待各方當事人,確保其均有充分與公正之陳述機會。
Arbitrators shall conduct proceedings without discrimination based on nationality, gender, race, religion, or any other status.
仲裁員執行職務時,不得基於國籍、性別、種族、宗教或任何身分因素而有歧視。
Article 6 – Communication with Parties / 第六條 與當事人之溝通
Arbitrators shall not engage in unilateral or private communications with any party concerning the arbitration.
仲裁員不得與任一當事人進行涉及仲裁事項之單方或私下溝通。
All communications concerning the proceedings shall be conducted through GMAC or with notice to all parties.
所有與仲裁程序相關之溝通,應經由 GMAC 或通知全體當事人方可為之。
Article 7 – Acceptance and Resignation / 第七條 接受與辭任
Before accepting an appointment, an arbitrator shall disclose any potential conflict of interest and confirm their ability to serve.
仲裁員於接受指派前,應揭露所有潛在利益衝突並確認可履職。
Arbitrators who are unable to continue due to illness, conflict, or other just cause shall immediately notify GMAC and request withdrawal.
仲裁員因疾病、衝突或其他正當理由無法繼續履職時,應立即通知 GMAC 並申請辭任。
Article 8 – Public Statements and Representation / 第八條 公開發言與代表行為
Arbitrators shall not make any public statements or comments regarding ongoing or completed cases.
仲裁員不得就進行中或已結束之案件作任何公開發言或評論。
Arbitrators shall not use their position or title in GMAC for personal promotion, political, or commercial purposes.
仲裁員不得利用其 GMAC 職銜作為個人宣傳、政治或商業用途。
Article 9 – Enforcement and Sanctions / 第九條 執行與懲處
Any arbitrator found to have violated this Code may be subject to warning, suspension, or removal from the GMAC Panel of Arbitrators.
仲裁員若違反本準則,GMAC 得視情節輕重予以警告、暫停或除名處分。
Serious violations may result in permanent disqualification and public disclosure of disciplinary action.
情節重大者,GMAC 得永久撤銷其資格,並公布處分結果。
Article 10 – Final Provisions / 第十條 附則
GMAC reserves the right to interpret and amend this Code as necessary.
GMAC 保留對本準則進行解釋及修訂之權利。
